Judge Byrne on May 10 suspends ct proceedings after Govt discloses that telephone calls of D Ellsberg were picked up by FBI wiretaps in late '69 and in early '70; disclosure, in form of memorandum filed with Byrne by acting FBI dir W D Ruckelshaus, comes 1 yr after Byrne ordered that all information on wiretaps be handed over to ct; Byrne asks Govt to produce all its logs and other records concerning taps; orders both sides to appear on May 11 to argue whether or not case should be immediately dismissed because of disclosure of wiretaps and fact that contents have apparently vanished from FBI sometime between July and Oct '71; defense attys contend that because of const issues involved it would like to argue judgment for acquittal that it hopes Byrne will respond to with written rulings on counts against defendants; Ruckclhaus, in memo, says that on May 4 he initiated investigation to int present and retired FBI personnel for purpose of determining whether there had been any wiretaps; says that on May 9 he recd preliminary rept in which former FBI employe recalled that in late '69 and early '70 Ellsberg had been overheard talking from electronic surveillance of Dr M Halperin's house; Govt contends that it has 'testimonial evidence' that electronic surveillance that picked up Ellsberg's conversation had been authorized by then Atty Gen Mitchell in accordance with natl security procedures; concedes that records have not been found; FBI int with former pres counsel C W Colson is turned over to ct; Colson relates that he knew of existence of White House investigations into Pentagon papers disclosure but was not involved in investigation into Ellsberg's background; says he recommends Hunt to take part; admits he knew of burglary of office of Ellsberg's psychiatrist but that he had been told by Ehrlichman and J Dean that in interest of natl security he should never discuss it; illus of Ellsberg and Russo talking to reporters
